To strengthen family unity and address skill shortages in key sectors, the New Zealand Government is introducing new rules granting open work rights to more partners of migrant workers. This initiative aims to attract and retain skilled workers by offering their families greater stability and opportunities.
Who Will Be Eligible?
From 2 December 2024, the following groups will be eligible for open work rights:
- Partners of Accredited Employer Work Visa (AEWV) Holders:
- Working in ANZSCO Level 1-3 roles and earning at least $25.29/hour (80% of the median wage).
- Earning at least $25.29/hour if they were already supporting a partner for a work visa on 26 June 2024.
- Partners of Essential Skills Work Visa Holders:
- Earning at least $25.29/hour.
- Partners of AEWV Holders in ANZSCO Level 4-5 Roles:
- Earning at least $47.41/hour (1.5 times of the median wage).
- Earning at least $31.61/hour in Green List roles and meeting specific requirements for that role.
- Earning at least $25.29/hour in roles covered by the Transport or Care Sector Agreements, provided they meet the wage requirements specified in the agreement.
Flexibility for Current Visa Holders
Partners currently on work visas with specific employment conditions will be able to apply for a variation of conditions to switch to open work rights, provided their partner meets the updated eligibility criteria.
How to Apply
Eligible individuals can apply for either a variation of conditions or a new work visa starting 2 December 2024.
